Trademark Rights Concerning Foreign Affairs

According to the provisions of China's trademark law, the right to exclusive use of trademark by a foreign party is basically the same as that of our clients.

      1申请商标注册。即商标注册申请人按法律规定的条件向商标局请求确认商标权。

      2初步审定，指商标局对申请注册的商标是否符合商标法规定的注册条件加以审查。

      3公告。指经过初步审定的商标在商标局编印的定期刊物《商标公告》上进行公告，征询社会各方面的意见，协助商标局进行审查。我国对申请注册的商标在初步审定并公告时采用申请在先的原利，即先申请者获得商标权。

      4驳回申请。指在初步审定程序中，凡不符合商标法的规定或者同他人在同一种商品或者类似商品上已经注册的或者初步审定的商标相同或者近似，由商标局驳回申请，不予公告。

      5异议。指申请人以外的任何人对于商标局初步审定公告的商标提出不应予以核准的意见，要求撤销初审公告的提议。

The objection shall be lodged within 3 months from the date of the preliminary verification of the trademark notice, and the parties shall not approve the registration or disagree with the objection made by the trademark office.

      6核准注册。指对初步审定的商标，自公告之日起 3个月内无人提出异议，或者经裁定异议不能成立，商标局即予以核准注册，向申请人颁发商标注册证，并予以公告。

      至此，商标注册人取得商标权。
